Andy advises on a wide range of commercial disputes, through conciliation, mediation and arbitration, as well as through traditional litigation. He specialises in advising on disputes relating to competition/anti-trust matters, data and privacy, professional negligence, banking and financial services, company acquisitions/sales and joint ventures, commercial contracts and insurance and reinsurance contracts. He has extensive experience in both international and domestic commercial arbitration, including under the UNCITRAL, ICC, AAA and LCIA Rules.
Andy also has extensive experience in acting on behalf of entities who are subject to investigation by regulators including the Central Bank of Ireland and the Competition and Consumer Protection Commission.
Relevant Experience
- Advising Volvo trucks / Renault trucks in relation to multiple follow on actions brought in the High Court in Ireland by purchasers of trucks arising out of a decision of an EU Commission decision to fine a number of truck manufacturers (including Volvo trucks / Renault trucks) a total of €2,926,509,000
- Advising CRH plc (the second largest buildings materials group in the world) in defending related competition proceedings brought by Framus Limited (and related companies in Liquidation) and Goode Concrete concerning alleged anti-competitive practices in the Concrete and Cement industries in Ireland
- Advising ABB Limited in respect of a follow on action for damages brought by ESB Limited arising out of an EU Commission decision concerning cartel activity in the gas insulation switch gear sector
- Advising Mars in relation to a claim for damages against HB Ice Cream Limited (owned by Unilever) for breaches of competition law in the impulse ice cream market in Ireland
- Advising Beef Industry Development Society in respect of a legal challenge brought by the Irish Competition Authority in respect of a proposed rationalisation scheme for the beef processing sector in Ireland
- Advising CRH plc on a successful High Court and Supreme Court challenge to the scope of documentation seized by the CCPC during a dawn raid at its wholly owned subsidiary, Irish Cement Limited
- Advising a major accountancy firm in relation to audits carried out by that firm of Irish funds involved in significant “Madoff” investments
- Advising a major French bank in a professional negligence claim against a fund administrator concerning significant investments made into specified funds
- Advising a major Irish plc in relation to a significant international joint venture dispute under the ICC rules where the applicable law was a foreign law and the seat of the Arbitration was in Paris
We regularly act for clients in high-value, multi-party and complex cross-jurisdictional arbitrations and our expertise spans a wide range of industries and sectors. Our team has detailed knowledge and experience of the most widely used international arbitration codes and centres, including the UNCITRAL Model Law on International Commercial Arbitration, the International Chamber of Commerce, the London Court of International Arbitration and the American Arbitration Association. As well as advising on arbitrations, we also regularly act for clients in relation to the enforcement of foreign arbitral awards in Ireland.
On the domestic side, we regularly advise on arbitrations arising from construction disputes, usually following procedures developed by Irish professional bodies such as the Royal Institute of the Architects of Ireland or Engineers Ireland.
