Jan K. Schaefer heads King & Spalding’s dispute resolution practice in Germany and is a highly experienced arbitration lawyer and international arbitrator. He represents German and international clients in domestic and cross-border disputes involving commercial contracts, construction, energy, foreign investment, and investor-state matters, while also appearing before German courts in proceedings connected with arbitration and other complex disputes.

Jan acts as counsel and advocate in high-value arbitrations conducted under a range of institutional rules, including those of the ICC, DIS, SCC, and ICSID, as well as in ad hoc proceedings under the UNCITRAL Rules. His experience spans post-M&A disputes, joint ventures, distribution and sales agreements, licensing arrangements, construction projects, energy matters, and foreign investment disputes.

His arbitration practice is complemented by substantial German court experience. Jan appears in first- and second-instance proceedings and regularly handles matters involving interim relief, enforcement applications, and the taking of evidence in support of foreign proceedings. He also advises clients on resolving disputes at an early stage through negotiation and other alternative dispute resolution techniques.

Alongside his counsel practice, Jan is frequently appointed as an arbitrator. He has served in approximately 85 arbitrations as chairman, party-appointed arbitrator, sole arbitrator, or emergency arbitrator under a variety of institutional and ad hoc rules. This extensive tribunal experience gives him a broad perspective on both the procedural and strategic dimensions of international arbitration.

Jan also advises on compliance and corruption issues, including in the context of post-M&A disputes, where he has worked closely with criminal defense counsel to coordinate parallel strategies. His broader disputes practice therefore combines arbitration, litigation, regulatory considerations, and cross-border risk management.

He has been recognized as a leading arbitration practitioner by Chambers Global, Chambers Europe, The Legal 500, and JUVE. Handelsblatt and Best Lawyers named him Lawyer of the Year for Arbitration for 2021/22, while JUVE and The Legal 500 have identified him as a Leading Name in Arbitration for many years.

Jan is a board member of the German Arbitration Institute (DIS) and the German-Singapore Lawyers’ Association. He has previously served on the board of the SCC and the Dutch Arbitration Association and as a member of the ICC Commission on Arbitration and ADR. He is also a member of the Litigation Committee of the German Federal Bar Association and speaks English, German, Dutch, and some French.

The firm’s International Arbitration & Litigation team handles complex commercial, construction, and investment treaty disputes across the full dispute lifecycle, from pre-dispute strategy and hearings through related court proceedings, enforcement, and asset recovery. With experience spanning more than 140 countries, the team coordinates multi-jurisdictional strategies, including parallel litigation, investigations, and proceedings across both common and civil law systems.

The practice covers high-value disputes arising from M&A transactions, joint ventures, shareholder arrangements, long-term commercial contracts, major construction and infrastructure projects, and investment treaties. Its lawyers act in proceedings under the rules of major arbitral institutions and ad hoc regimes, including ICSID matters, and regularly handle disputes involving sovereign states, state-linked entities, sanctions, sovereign immunity, and broader public international law issues.

The team also has substantial experience with arbitration-related litigation, enforcement, and asset recovery, coordinating court applications and cross-border recovery strategies with local counsel and investigators where necessary. Its sector experience is particularly strong in energy, mining, major infrastructure, life sciences, financial services, private capital, chemicals, consumer goods, aviation and aerospace, and technology.

Many matters involve sophisticated transactions, first-of-kind projects, and regulatory or geopolitical considerations. The disputes team works closely with colleagues across the firm to combine sector knowledge, transactional insight, and international disputes experience in matters where the legal and commercial issues are often highly complex and without clear precedent.

Founded in Atlanta in 1885, King & Spalding is an international law firm with more than 1,300 lawyers across 26 offices in the United States, Europe, the Middle East, and Asia-Pacific. The firm represents a broad range of clients, including major global corporations, financial institutions, investors, governments, and emerging businesses, and has handled matters in more than 160 countries.

The firm’s capabilities span disputes, transactions, government regulation and investigations, corporate and finance matters, intellectual property, labor and employment, restructuring, real estate, tax, healthcare, energy, infrastructure, technology, life sciences, and other areas. Its lawyers advise clients across a wide range of industries on significant litigation, major transactions, regulatory challenges, internal investigations, and strategic business matters, often coordinating multidisciplinary teams across jurisdictions.

King & Spalding emphasizes collaboration, industry knowledge, and an understanding of the commercial and cultural context in which its clients operate. Its global platform enables the firm to combine local market experience with cross-border capabilities, providing coordinated counsel on complex matters that may involve multiple legal systems, regulators, and business environments.
